Part 1 — Terms & Conditions
Art. 1 — Purpose and scope
These Terms & Conditions ("T&C") govern all self-drive motor vehicle rentals (KYMCO 125cc scooters) offered by Scoot Spain, operating under Spanish self-employed (autónomo) status, to any renter (an adult individual or a legal entity), hereinafter referred to as "the Customer".
Any booking, regardless of the channel used (mobile app, B2C platform such as Momoven/Riderly/BikesBooking, WhatsApp Business, email, website, or in-person handover), implies full and unreserved acceptance of these T&C.
These T&C are available on request and are systematically provided to the Customer before the rental agreement is signed.
Art. 2 — Booking and confirmation
A booking is deemed firm and final once Scoot Spain has received: (a) full payment or the agreed deposit, and (b) copies of a valid driving licence and an identity document for the driver.
The Customer receives written booking confirmation (email or WhatsApp message) stating the pick-up date and time, rental duration, assigned vehicle, total amount, and applicable security deposit.
Without written confirmation from Scoot Spain, no booking is considered valid.
Art. 3 — Rates and payment
3.1 — Applicable rates
Rates set on the website: Rental prices are defined and displayed on the Scoot Spain website (online booking flow), based on the dates, vehicle and duration selected. Only the rates shown on the website at the time of booking and confirmed in writing by Scoot Spain are contractually binding. These Terms do not constitute a price list and do not override prices published on the website.
What is included: unless otherwise stated on the website at the time of booking, displayed rates are presented as all-inclusive (insurance, helmets and equipment as per the offer). Amounts are VAT-inclusive (21% IVA).
3.2 — Payment methods
Payment may be made by debit/credit card (Visa / Mastercard), bank transfer (SEPA), or cash (up to €1,000 in line with Spanish law — Ley 7/2012 on cash payment limits).
Full payment is required before the vehicle is handed over. No rental will be granted without full payment.
Art. 4 — Security deposit (fianza)
A €300 security deposit is required for every rental (the amount is aligned with the fleet insurance's damage excess). Depending on the method indicated at the time of booking, it is held either as a card pre-authorisation/hold on the Customer's card, or in cash at vehicle hand-over.
The deposit is returned within a maximum of 24 hours after the vehicle is returned, provided there is no damage, no pending fines, no missing fuel, and no other charges attributable to the Customer.

Art. 5 — Cancellation and changes

Changes (date, duration) are possible subject to availability, at least 24 hours before the rental start, at no extra cost. Outside this window, a €10 amendment fee may apply.
Art. 5 bis — No right of withdrawal. Pursuant to Article 103.l) of Royal Legislative Decree 1/2007 (TRLGDCU), the statutory 14-day withdrawal right applicable to distance contracts does NOT apply to this rental, as the contract sets a fixed date and duration of performance. Only the cancellation policy in Art. 5 above applies.
Art. 5 ter — Hojas de reclamaciones (official complaint forms). In accordance with the consumer protection regulations of the Valencian Community (Decree 77/1994 and subsequent amendments), Scoot Spain holds official complaint forms (hojas de reclamaciones), made available free of charge to the Customer on request at the vehicle hand-over point, together with visible signage informing customers of this right.
Art. 6 — Vehicle use conditions
The Customer agrees to use the vehicle in compliance with the Spanish Highway Code (Royal Legislative Decree 6/2015) and these T&C. The following are strictly prohibited:
- Subletting, lending, or transferring the vehicle to a third party not named on the contract
- Driving under the influence of alcohol (above 0.25 mg/L exhaled air / 0.50 g/L blood; lowered to 0.15 mg/L exhaled air / 0.30 g/L blood for licences held less than 2 years and for professional drivers) or drugs
- Taking part in races, competitions, or motorised sporting activities
- Using the vehicle outside Spanish territory without prior written authorisation
- Transporting dangerous or illegal goods, or goods exceeding the vehicle's capacity
- Riding without an approved helmet (driver and passenger)
Any serious breach of these conditions may result in immediate termination of the rental agreement, with no refund and no return of the security deposit.
Art. 7 — Insurance and liability
The vehicle is covered by mandatory third-party liability insurance (seguro de responsabilidad civil) in accordance with the Spanish Motor Liability and Insurance Act. This cover is included in the rental price.
The Customer remains liable for damage caused to Scoot Spain's vehicle through their fault, negligence, or improper use. The Customer's liability is capped at the amount of the security deposit paid, except in cases of intentional damage, driving under the influence, driving without a valid licence, or a clear breach of these T&C — in which cases the Customer's liability is unlimited.
The Customer is encouraged to check whether their own insurance (premium bank card, travel insurance) covers damage to vehicles rented abroad. Scoot Spain does not offer a supplementary insurance product.
Art. 8 — Traffic offences and fines
The Customer is solely responsible for any traffic offence committed during the rental period. If a fine notice (denuncia, notificación de sanción) is received after the end of the contract, the Customer has 15 days to pay the relevant authority and provide proof of payment to Scoot Spain.
After this deadline, Scoot Spain will pay the fine and charge the Customer the fine amount plus a €25 admin fee, deducted via any available means (card pre-authorisation, a new charge, or a collection procedure).
Scoot Spain has a legal obligation (not a mere option) to disclose the Customer's identifying details to the Spanish traffic authorities for the purpose of identifying the offending driver, pursuant to Articles 9 bis and 11 of Royal Legislative Decree 6/2015 (Traffic Act). The Customer is informed of this and agrees to provide any necessary information.
Art. 9 — Mediation and complaints
For any complaint, the Customer may contact Scoot Spain by email at info@scootspain.com or by post at the operator's business address. A response will be provided within 5 business days.
If a dispute is not resolved amicably, the Customer may refer it to the competent consumer mediation body. Pursuant to Article 90.2 of Royal Legislative Decree 1/2007 (TRLGDCU), a Customer acting as a consumer may also bring proceedings before the Spanish courts of their own domicile, or those of Alicante.
Governing law: Spanish law. Between professionals, the courts of Alicante (Spain) have exclusive jurisdiction; for consumer Customers, without prejudice to the right to bring proceedings before the courts of their own domicile (Art. 90.2 TRLGDCU).
Part 2 — Privacy Policy (GDPR / LOPDGDD)
In compliance with EU Regulation 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD)

As the activity is carried out under self-employed status with a limited volume of processing (individual, private customers), formally appointing a Data Protection Officer (DPO) is not mandatory. The controller assumes the GDPR obligations directly.
2. Data collected
In connection with booking and renting a vehicle, Scoot Spain collects the following categories of data:

Scoot Spain does not collect special category data within the meaning of Article 9 GDPR (health data, ethnic origin, political or religious beliefs, sexual orientation). No full card data (card number, CVV) is stored — only the temporary pre-authorisation is retained.

5. Your rights
Under the GDPR (Articles 15 to 22) and the LOPDGDD, every customer has the following rights:

If there is no response, or an unsatisfactory response, within 30 days, the Customer may lodge a complaint with the AEPD (Agencia Española de Protección de Datos): www.aepd.es — C/ Jorge Juan, 6, 28001 Madrid.
6. Data sharing and recipients
The Customer's personal data is never sold or transferred to third parties for commercial purposes. It may be shared with:

No data is transferred outside the European Union, unless the GPS or payment provider is established outside the EU — in which case appropriate safeguards (European Commission standard contractual clauses) apply.
7. Data security
Scoot Spain implements appropriate technical and organisational measures to protect data against unauthorised access, loss, or destruction, including:
- Paper documents (contracts, ID copies) kept under lock
- Digital data access protected by a strong password and two-factor authentication
- Encrypted messaging communications (WhatsApp Business)
- No storage of full card numbers — pre-authorisation only via a secure PCI-DSS system
- Photos stored on encrypted media — automatically deleted after 6 months
In the event of a data breach likely to result in a high risk to the Customer's rights and freedoms, the Customer will be notified within 72 hours in accordance with Article 33 GDPR.
8. Cookies and trackers
The Scoot Spain website (the "Site") uses cookies and similar technologies to ensure it functions properly, to secure the booking and payment process, and, subject to the Customer's consent, to measure Site traffic.
8.1 — Strictly necessary cookies
These cookies are essential to the Site's operation (booking session management, cart, vehicle and date selection, online payment security). They do not require the Customer's prior consent under applicable regulations (Art. 22.2 of the Spanish LSSI, AEPD guidance) and cannot be disabled without preventing booking.
8.2 — Analytics and preference cookies
If the Site deploys audience-measurement cookies (visit statistics) or preference cookies (language, currency), these are only set after the Customer's explicit consent, collected via the cookie banner shown on first visit. The Customer may accept, refuse, or customise these choices at any time via that banner or their browser settings.
8.3 — Third-party cookies
The Site may use third-party providers (payment, hosting, analytics) that may set their own cookies, governed by their own privacy policies. The list of active providers and the retention period of their cookies is detailed in the Site's cookie management banner.
8.4 — Retention and management
Cookies are retained for a maximum of 13 months, in line with AEPD guidance. The Customer may change their preferences at any time via the Site's cookie banner, or delete cookies already set via their browser settings. Disabling non-essential cookies does not prevent use of the Site but may limit certain features.

9. Policy changes
This privacy policy may be updated at any time to reflect legal, regulatory, or operational changes. The version in force is the one communicated to the Customer at the time of booking.
